Waiver and Release of Liability

The short version

In plain terms, here's what you're agreeing to:

  • You're choosing to do this. You can stop, rest, modify, or leave at any point, for any reason.

  • You know your body and I don't. You're responsible for deciding whether this practice is right for you, and for checking with a doctor if there's any reason to.

  • I can't see you properly over video. I can't correct your alignment, I often won't notice when something's going wrong, and I can't help if something happens.

  • Your space is yours to make safe. Clear floor, stable footing, nothing to trip over or knock into, weights handled carefully.

  • Movement carries risk. You understand that, and you're accepting it.

  • If you're hurt, you agree not to hold me responsible — unless I've been reckless or done something willfully wrong.

Before the formal part

This is a movement practice, and you are the one moving. Work within your own range. Go slowly. If something hurts, stop — nothing in this practice requires pushing through pain. You're welcome to sit out anything, to rest, to use lighter weights or none at all.

Terms

By registering for and participating in these sessions, you acknowledge and agree:

1. Voluntary participation. Participation is entirely voluntary. You may stop, rest, modify, or leave at any time, for any reason, without explanation.

2. Physical readiness. You are responsible for determining whether this practice is appropriate for you. You should consult a physician before participating, particularly if you are pregnant, recovering from injury or surgery, or have any cardiovascular, respiratory, musculoskeletal, balance, or blood-pressure condition. You confirm you have no condition known to you that makes participation unsafe.

3. This is not medical care. Instruction offered in these sessions is not medical advice, diagnosis, treatment, physical therapy, or rehabilitation, and is not a substitute for care from a qualified professional. J. Mackenzie Hawkins is not a licensed medical provider and nothing said during a session should be treated as clinical guidance.

4. Remote instruction. These sessions take place over video. The instructor cannot fully observe your posture, alignment, or physical state, cannot reliably identify when you are at risk, and cannot provide physical assistance or emergency help. You accept these limitations as inherent to the format and accept responsibility for your own safety during each session.

5. Your space is your responsibility. Because sessions take place wherever you are, you are responsible for practicing in a safe environment: adequate clear floor space, stable footing, no obstacles or hazards within reach, sufficient overhead clearance, and secure handling and storage of any weights or equipment you choose to use.

6. Assumption of risk. Physical activity carries inherent risk. You understand that participation may result in injury including, without limitation, muscle strain, sprains, joint or back injury, falls, injury from dropped or mishandled weights, aggravation of existing conditions, cardiac events, and in rare cases serious or permanent injury. Knowing these risks, you choose to participate.

7. Release. To the fullest extent permitted by law, you release and hold harmless J. Mackenzie Hawkins, and her instructors, agents, and affiliates, from any claim, demand, or cause of action arising out of your participation in these sessions, including claims based on ordinary negligence. This release does not extend to gross negligence, recklessness, or willful misconduct.

8. Age. Participants must be 18 or older. A participant under 18 may take part only with the consent and supervision of a parent or legal guardian, who accepts these terms on their behalf.

9. Agreement. You have read and understood these terms. Your electronic acceptance at registration has the same effect as a signature. This agreement is governed by the laws of the State of New Jersey.
